TERMS OF SALES

 

In the event of a dispute, only the French version of these General Conditions of Sale (GTC) is valid.

The validation of the order by the buyer implies his acceptance of these general conditions of sale in their entirety. The contract for the sale of articles by Internet is concluded between, Kitchen Brocante - and the buyer. The purchaser declares to have the capacity to contract with Kitchen Brocante on the basis of the general conditions of sale present on the Internet site of Kitchen Brocante (hereinafter referred to as “our site”). These general conditions of sale shall prevail over any other condition stated on our site.

1.Price
The prices are indicated by default in Swiss francs, or calculated automatically according to the exchange rates of the day.

2.Old / used products

The buyer of Kitchen Brocante must keep in mind that all our items sold on the site are second-hand goods sold as is. The buyer can not have any guarantee on a second-hand product, in fact, the physical goods sold by Kitchen Brocante are old goods that may contain defects, traces of wear due to their age, chips, stains and cracks, this are not machined or mass produced products. All products on the site  www.kitchenbrocante.com  are unique. The photos are an integral part of the description and make it possible to learn about the state of wear and possible defects of the objects. As a result, these objects cannot, by their ancient nature, correspond to current health and safety standards. Any use of these objects by the buyer can in no way engage our responsibility.

 

3.Right of withdrawal and return
Following a purchase, the buyer has 48 hours to cancel it and be fully refunded. A withdrawal request is MANDATORY. All requests must be made by e-mail to kitchenbrocante@gmail.com specifying the order number. After the 48 hour deadline, and if the package has already been sent, we will not be able to propose the cancellation of the purchase.

In accordance with the legislation governing mail order sales in force for online sales, the buyer has the option of returning the items ordered to us within 7 days of the delivery date being fully reimbursed for the price of the item concerned ( excluding postage). A return request is MANDATORY. All return requests must be made by email to kitchenbrocante@gmail.com
If seven days have passed since purchase, unfortunately we cannot offer a refund. To be eligible for a return, the item must be in the same condition as it was shipped. The buyer is responsible for paying the shipping cost to return the item. Transportation costs are not refundable. The buyer will receive a refund for the original cost of the item (excluding shipping costs).

4.Payment terms

- PayPal
PayPal, the undisputed leader in online payment, makes it very easy for buyers to make payments over the Internet. PayPal helps protect your credit card information with the best systems on the market for security and fraud prevention. When the buyer uses PayPal, their financial information is never given to us.

- Credit / debit card

Online payment by CB Visa / maestro / Master card is managed by a Wix application, thus guaranteeing the greatest security, payment information and personal data are encrypted and secure and are never communicated to us.

5.Delivery and deadlines

The amount of Shipping costs is calculated according to the weight and the destination, it is automatically communicated to the validation of the basket and is included in the total price to pay of the order. The product will be delivered to the contact details indicated by the buyer in the form filled in when ordering. The packaging is carried out by Kitchen Brocante, the boxes, bubble wrap and other supplies are of good quality and are used effectively to ensure the safety of the products transported to customers.  Delivery is made by post.

Packages are posted within a maximum of 5 working days after ordering. The buyer is notified by email when his package has been posted.

The products always travel at the risk of the recipient who in the event of delay, damage or shortage must take recourse against the carrier or make the necessary reservations with the latter to allow this recourse to be exercised. Kitchen Brocante disclaims all liability related to problems of damage, breakage, deterioration or loss of packages. Kitchen Brocante is no longer responsible for the buyer's package as soon as it is taken over by the carrier.

Likewise, if the information provided by the buyer is inaccurate, we cannot be held responsible for the impossibility of delivering and meeting the deadlines.  

6. Withdrawal of purchases free of charge in Vevey

If the buyer wishes to collect their purchases free of charge in Vevey (canton of Vaud, Switzerland), please contact us first by email with the list of items in question, in order to arrange an appointment together.

7. Damaged parcel
If at the time of receipt of the package the buyer finds that it has been opened or damaged during transport, he must report this to the postman who must provide a document proving this damage. Without this proof, we will not be able to complete the formalities with La Poste. 

Kitchen Brocante cannot be held responsible in any way if the merchandise has been damaged during transport.

8.Loss of your package
Packages are sent by Swiss post at the “Economy” rate. 

“Economy” mode does not include a tracking number or insurance for shipments outside Switzerland. Kitchen Brocante cannot be held responsible for the loss of a package by post.

9. Unclaimed parcel

If a parcel is not claimed by the buyer, postage will be invoiced to us by post for the return of the parcel to our depot. We will therefore be obliged to re-invoice all of these costs to the buyer.

10. Intellectual property

All the elements published within the site www.kitchenbrocante.com, such as images, photographs, videos, writings, animations, programs, graphic charter, utilities, databases, software, are protected by the provisions of the Code of the intellectual property and belong to the seller.  The buyer agrees not to infringe the intellectual property rights relating to these elements and in particular to reproduce, represent, modify, adapt, translate, extract and / or reuse a qualitatively or quantitatively substantial part, to the exclusion of acts necessary for their normal and compliant use.  

11. Computing and freedoms
All personal data will be considered confidential and will under no circumstances be passed on to a third party.
